Terms of Service

The following Terms of Service ("Terms") govern your access to and use of the Fusey platform, including any content, functionality and services offered on or through fusey.gg (the "Site"), operated by Fusey B.V., a private limited company (besloten vennootschap) registered in the Netherlands ("Fusey", "we", "us"). "You" or "user" means you as a user of the Site.
Please read the Terms carefully before you start to use the Site. By using the Site, opening an account, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Creator Guidelines, which are incorporated herein by reference.
If you do not want to agree to these Terms, you must not access or use the Site.

1. Key Terms

Sponsors (also called "Community Owners" or "Buyers") are users who purchase promotional services on Fusey.
Creators (also called "Content Creators" or "Sellers") are users who offer and provide promotional services on Fusey.
Packages are the service listings created by Creators, describing the promotional service, price, delivery timeframe, and included deliverables.
Orders are the formal agreements between a Sponsor and Creator after a Package is purchased, including all associated payment, delivery, and communication.
Platform Fee is the fee charged by Fusey on each transaction, currently set at 15% of the Creator's listed price. The Platform Fee is included in the total price paid by the Sponsor. The Sponsor pays one combined price that covers both the Creator's listed price and the Platform Fee.

2. About the Platform

Fusey is a two-sided marketplace that connects content creators with community owners in the gaming space. Creators offer promotional services through Packages, and Sponsors purchase those Packages to promote their gaming communities.
Fusey acts solely as an intermediary. We are not a party to any agreement between Creators and Sponsors. We facilitate the transaction, hold funds in escrow, and provide dispute resolution. Sponsors confirm they will engage all Creators as independent contractors.

3. Eligibility

To use Fusey you must:
  • Be at least 16 years of age, or have parental/guardian consent if required under your local law.
  • Have the legal capacity to enter into a binding agreement.
  • Not have been previously banned from the Platform.
  • Not be subject to any economic sanctions or trade restrictions imposed by the European Union, United States, or any other applicable jurisdiction.
By registering, you represent and warrant that you meet all of these requirements. If you do not meet all of these requirements, you must not access or use the Site.

4. Account Registration

You register via a third-party authentication provider (Google, Discord and X/Twitter). You are responsible for the security of your account and any activity under it. You must not share your account credentials or allow others to access your account.
You agree to provide accurate and complete information and to keep it up to date. You may not create a false identity, misrepresent your identity, create an account for anyone other than yourself, or use another user's account. Users are limited to one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the community will be disabled.
We may suspend or terminate accounts with false or misleading information.

5. Platform Fees

Fusey charges a Platform Fee of 15% on each transaction. The Platform Fee is included in the total price paid by the Sponsor. The Sponsor pays one combined price that covers both the Creator's listed price and the Platform Fee. The Creator receives the listed price.
Example: Creator lists a Package for €100.00. Sponsor pays €115.00 (Creator's price + Platform Fee). Fusey receives €15.00.
All prices are in Euro (EUR). The Platform Fee is subject to Dutch VAT (BTW) where applicable.
Fees are non-negotiable and may be updated with 30 days' notice.

6. The Fusey Guarantee

Every Order on Fusey is backed by the Fusey Guarantee. Your payment is held in escrow and only released to the Creator after you approve the delivery. If the Creator fails to accept or deliver, you are automatically refunded in full. You have 72 hours to review each delivery, and disputes are handled by our team.
The Fusey Guarantee and the refund rights described in our Refund Policy constitute your sole and exclusive remedy with respect to any Order placed through the Platform. For full details, see our Refund Policy.

7. Payments and Escrow

All payments are processed through Stripe. When a Sponsor purchases a Package:
  1. The payment is authorized and held in escrow (not immediately captured).
  2. The Creator has 72 hours to accept or decline the Order.
  3. If accepted, the payment is captured. If declined or not responded to within 72 hours, the payment authorization is cancelled. Because the payment was never captured, no money leaves the Sponsor's account and no refund is needed.
  4. Upon successful delivery and approval, the Creator's earnings become available for withdrawal.
Fusey does not store credit card or payment details. All payment data is handled by Stripe in accordance with PCI-DSS standards.
When placing an Order you may only use funds obtained from legal sources that are not connected to any unlawful or fraudulent activities.

8. Orders and Delivery

8.1 Order Flow

  • Waiting Acceptance: Sponsor has paid. Creator must accept within 72 hours.
  • Accepted: Creator is working on delivery. Must deliver within the agreed timeframe.
  • Delivered: Creator submitted delivery. Sponsor has 72 hours to approve or open a dispute.
  • Delivery Approved: Order completed. Creator can withdraw earnings.

8.2 Automatic Actions

  • If the Creator does not accept within 72 hours, the Order is automatically declined and the Sponsor is fully refunded.
  • If the Creator does not deliver within the agreed deadline, the Order is automatically cancelled and the Sponsor is fully refunded.
  • If the Sponsor does not review the delivery within 72 hours, the delivery is automatically approved.

8.3 Seller Obligations

Creators are required to meet the delivery time specified in their Package. Failing to do so will result in automatic cancellation and may affect the Creator's standing on the Platform.
Creators must send completed files and/or proof of work when marking the Order as delivered. The deliver function may not be abused to circumvent Order guidelines. Using the deliver function when an Order was not fulfilled may result in cancellation and a warning.

9. Refunds

Refunds are issued automatically in the following cases:
  • The Creator declines the Order or fails to accept within 72 hours.
  • The Creator fails to deliver within the agreed deadline.
  • A dispute is resolved in the Sponsor's favor by Fusey administration.
Refunds are processed through Stripe to the original payment method. Fusey does not offer refunds for completed and approved Orders. When a refund is issued, the full amount including the Platform Fee is refunded.

10. Disputes

If a Sponsor is dissatisfied with a delivery, they may open a dispute within the review period. We encourage Sponsors and Creators to try and settle conflicts amongst themselves first.
Disputes are reviewed and resolved by Fusey administration. The resolution may result in:
  • The Order being completed (Creator receives earnings), or
  • A full refund to the Sponsor (Creator forfeits earnings).
Fusey's dispute resolution decision is final. Both parties will be notified of the outcome with an explanation.

11. Creator Payouts

Creators receive payouts via Stripe Connected Accounts. To receive payouts, Creators must complete Stripe's identity verification (KYC) process. Fusey is not responsible for Stripe's verification requirements or decisions.
Fusey transfers the Creator's full available balance upon request. Withdrawals are always for the full balance. Partial withdrawals are not supported. Creators are solely responsible for their own tax obligations, including income tax and VAT where applicable.

12. Reviews

Reviews are an important part of the Fusey marketplace. Reviews must come from legitimate Orders.
  • Reviews will not be removed unless there are clear violations of our Terms.
  • Withholding delivery to gain favorable reviews is prohibited.
  • Soliciting the removal of reviews through cancellations is prohibited.
  • Purchases arranged to artificially enhance ratings may result in suspension of all related accounts.

13. Non-Circumvention

You may not offer, solicit, or accept offers to contract, engage, pay, or make payment outside of the Site. If you have been asked to use an alternative payment method or to receive/provide services outside of Fusey, please report it immediately to our support team.
A violation of this non-circumvention requirement is a material breach of these Terms and may lead to permanent suspension of your account.

14. Prohibited Conduct

You agree not to:
  • Use the Platform for illegal purposes or to conduct illegal activities.
  • Provide false or misleading information in your profile or Packages.
  • Circumvent Platform payment processing.
  • Harass, threaten, bully, or abuse other users. We condemn harassment and hate speech.
  • Discriminate against any other user based on gender, race, age, religious affiliation, sexual orientation, or otherwise.
  • Upload malicious files, spam, viruses, or harmful content.
  • Create multiple accounts to evade bans or manipulate reviews.
  • Scrape, crawl, or use automated means to access the Platform without permission.
  • Infringe upon the intellectual property rights of others.
  • Publish or post other people's private and confidential information.
  • Attempt to gain unauthorized access to, interfere with, or damage the Site or connected systems.
  • Use the Site in any manner that could damage, disable, or overburden it.
Communication on Fusey should be friendly, constructive, and professional. Rude, abusive, or improper language and violent or threatening messages will not be tolerated and may result in account suspension.

15. Intellectual Property

15.1 Platform IP

The Site, including its features, design, and branding, are exclusively owned by Fusey B.V.. Users have no right to copy, modify, distribute, or create derivative works from the Site or its content.

15.2 User Content

All content uploaded by users is User Generated Content ("UGC"). By uploading content to the Site, you represent and warrant that you own or have obtained all necessary rights and that the content does not infringe any third-party rights.
You retain ownership of content you upload but grant Fusey a non-exclusive, worldwide license to display and distribute it on the Platform as necessary to provide the service. Fusey may also use delivered work that the Sponsor has made public through a review for marketing and promotional purposes.

15.3 Intellectual Property Claims

Fusey will respond to clear and complete notices of alleged copyright or trademark infringement in accordance with applicable law, including the EU Digital Services Act. If you believe your intellectual property rights have been infringed on the Site, contact us at fuseybusiness@gmail.com with:
  • Identification of the copyrighted work or trademark claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, with enough detail for us to locate it.
  • Your contact information (name, address, email, phone number).
  • A statement that you have a good faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights owner.
We will review and act on legitimate claims promptly. Violating content may be removed or disabled.

16. Content Moderation

Fusey is not obligated to proactively check all content posted by users. We are entitled to carry out checks to identify illegal or incompatible content and to take appropriate measures including:
  • A warning with details of the violation.
  • Removal of content or Packages.
  • Temporary suspension of your account.
  • Permanent removal from the Platform.
If we take action concerning your account or content, we will notify you with an explanation. You may file a complaint against the decision by contacting our support team within six months. We will handle complaints in a timely, non-discriminatory, and objective manner.

17. Confidentiality

Creators agree to treat any information received from Sponsors as confidential. Specifically, Creators agree to: (i) maintain all such information in strict confidence; (ii) not disclose it to any third parties; (iii) not use it for any purpose except for delivering the services; and (iv) not copy or reproduce it without the Sponsor's permission.

18. Limitation of Liability

To the maximum extent permitted by Dutch law (Burgerlijk Wetboek, Book 6):
  • Fusey is not liable for indirect, incidental, or consequential damages.
  • Fusey is not liable for the quality, accuracy, or legality of Creator services or Sponsor instructions.
  • Fusey does not guarantee the behavior, conduct, safety, suitability, or ability of any user.
  • Fusey's total liability for any claim is limited to the amount of fees received by Fusey in connection with the specific transaction.
  • Fusey is not responsible for downtime, data loss, or service interruptions beyond our reasonable control.
  • Users are responsible for scanning all transferred files for viruses and malware.
  • Fusey is not liable for failures or delays caused by circumstances beyond our reasonable control, including but not limited to third-party service outages (Stripe, authentication providers), natural disasters, government actions, or internet infrastructure failures.

19. Indemnification

You agree to indemnify and hold harmless Fusey B.V., its directors, employees, and agents from any claims, losses, or damages arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

20. Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the GDPR.

21. Modification of Terms

We may update these Terms at any time. Material changes will be communicated via email or Platform notification at least 30 days in advance. Continued use of the Platform after changes take effect constitutes acceptance.

22. Termination

You may delete your account at any time through your account settings. Fusey may suspend or terminate your account for violation of these Terms, with or without notice.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including liability, indemnification, intellectual property, and confidentiality) will remain in effect.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Platform shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
